Submitting information through this Site does not obligate you to sell your property, and it does not obligate SJ Properties to purchase your property or make an offer.

Any potential real estate transaction will be subject to additional due diligence, mutually acceptable written agreements, and any other requirements applicable to the transaction.

2. IMPORTANT REAL ESTATE DISCLOSURE

SJ Properties purchases real estate as a principal for its own account and may purchase, renovate, hold, rent, finance, assign, or resell properties it acquires.

SJ Properties is affiliated with a licensed Ohio real estate agent. When SJ Properties is considering purchasing your property for its own account, the affiliated licensee is not acting as your real estate agent or representing you as a client unless a separate written agency agreement expressly states otherwise.

You are not required to sell your property to SJ Properties and are free to consult with or obtain representation from a real estate agent, attorney, accountant, tax professional, lender, housing counselor, appraiser, or other professional of your choosing.

Nothing on this Site constitutes legal, tax, financial, lending, foreclosure-prevention, or other professional advice.

You must be at least 18 years of age to use this website, submit an inquiry, or participate in our SMS/text messaging program. By using this website, submitting a form, or opting in to receive text messages from SJ Properties of Southwest Ohio, LLC, you represent and warrant that you are at least 18 years old.

3. NO GUARANTEE OF AN OFFER OR CLOSING

References on the Site to cash offers, direct purchases, potential closing timelines, purchasing properties “as-is,” paying certain closing costs, or similar benefits describe transactions that may be available.

They are not guarantees that SJ Properties will purchase a particular property or that every transaction will qualify for the same terms.

5. COMMUNICATIONS

Message frequency varies. Message and data rates may apply. Your wireless carrier's message and data rates may apply to messages sent to you and messages you send to us. Carriers are not liable for delayed or undelivered messages.

You may cancel the SMS service at any time by replying STOP. After you send STOP, we may send you a message confirming that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you subsequently opt in again.

7. FORECLOSURE AND FINANCIAL HARDSHIP

SJ Properties is not a foreclosure rescue service, lender, law firm, credit counseling agency, or government agency, and we do not guarantee that selling a property will stop or resolve a foreclosure.

8. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and its original content, including text, graphics, logos, photographs, videos, website design, and other materials, are owned by or licensed to SJ Properties and are protected by applicable intellectual property laws.

You may access and use the Site for your personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish, sell, exploit, or otherwise use our proprietary Site content for commercial purposes without our prior written permission.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless SJ Properties of Southwest Ohio, LLC and its members, managers, employees, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person's rights.

18. GOVERNING LAW

Any legal proceeding that is not otherwise subject to an enforceable dispute-resolution agreement shall be brought in a court of competent jurisdiction in Ohio, subject to applicable law.

19. DISPUTE RESOLUTION

Before filing a lawsuit concerning a dispute arising from these Terms or use of the Site, you and SJ Properties agree to make a good-faith effort to resolve the dispute informally.

Either party may initiate this process by providing written notice describing the dispute. The parties will have 30 days following receipt of the notice to attempt to resolve the matter before initiating formal proceedings, unless immediate relief is permitted or required by applicable law.

20. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and SJ Properties regarding use of the Site.

These website Terms do not replace or modify the terms of any separately executed real estate purchase agreement or other written contract between you and SJ Properties.

If there is a conflict between these Terms and a signed agreement governing a real estate transaction, the signed agreement will govern that transaction.
